What the law asks of restaurant posts

Restaurants carry a little more risk than most small businesses because posts talk about food, prices and sometimes alcohol.

Reviews and guests

The FTC's rule banning fake reviews and testimonials took effect on 21 October 2024. Do not post reviews you wrote or paid for. If a guest or influencer was comped, the FTC's Endorsement Guides (16 CFR Part 255, revised in 2023) say that connection must be disclosed.

Allergens and health claims

Do not write 'gluten-free', 'nut-free' or 'allergen-friendly' unless your kitchen can back it. In England, the Food Information Regulations 2014 enforce the duty to declare the 14 major allergens, and Natasha's Law, in force since 1 October 2021, requires a full ingredients list with allergens emphasised on food prepacked for direct sale. Wales, Scotland and Northern Ireland have their own equivalent rules.

Prices and fees

If you add a mandatory service charge or fee, show the real price. California's SB 478, in force since 1 July 2024, generally requires advertised prices to include mandatory fees. Restaurants and bars have an exception under SB 1524: a mandatory fee can be listed separately if it is shown clearly and conspicuously wherever prices are shown, such as on the menu. Other states and countries have similar rules. In the UK, the Digital Markets, Competition and Consumers Act 2024 treats leaving mandatory fees out of a price as misleading for practices from 6 April 2025.

Alcohol

Alcohol marketing has its own rules by state in the US, and in the UK by the Advertising Standards Authority's CAP Code, section 18. Its rule 18.16 says people shown drinking or playing a significant role in an alcohol ad must neither be nor seem to be under 25.
