Rules that apply to small business posts

A small business has fewer rules than a bank or a law firm, but a few apply to almost every post. They are the ones that cause complaints, so read each post with them in mind.

Endorsements and reviews

In the US, the FTC's Endorsement Guides (16 CFR Part 255, revised in 2023) say you must disclose a material connection, such as a free product or a payment, when someone endorses you. The FTC's rule on fake reviews and testimonials took effect on 21 October 2024. Do not post reviews you wrote, bought or edited, and do not present a staff member's praise as a customer's.

Prices and sales

The FTC's Guides Against Deceptive Pricing (16 CFR Part 233) say a 'was' price should be a price you really charged. If a post says 'half price', the first price has to be real.

Where it was made

A 'Made in USA' claim on a label or an online listing is covered by the FTC's Made in USA Labeling Rule (16 CFR Part 323, in force since 13 August 2021). Only say it if the product qualifies.

Giveaways and pictures of people

Instagram and TikTok each publish their own promotion rules for giveaways, and you need permission to show a customer's face or reuse their post. Your industry may add its own rules on top, for example for food, alcohol, health or financial services. Where there is a page on this site for your trade, read its rules section as well.
