Fundraising, privacy and tax rules for nonprofit posts

Politics

In the US, an organisation exempt under section 501(c)(3) of the Internal Revenue Code may not participate or intervene in any political campaign for or against a candidate. The IRS says public statements made on behalf of the organisation, verbal or written, for or against a candidate violate this, and a post on the organisation's own account is a statement on its behalf. Post about issues, not candidates.

Asking for money

Most US states require a charity to register before soliciting donations from their residents. An online post reaches every state, so check with your state's charity regulator and the National Association of State Charity Officials.

Saying a gift is tax-deductible

Only say so if the organisation is eligible and the gift would qualify. Where a donor receives something in return for a payment over 75 dollars, US law requires a written disclosure of the deductible part (Internal Revenue Code section 6115).

People you serve

Photos and stories of beneficiaries need informed consent, particularly for children and anyone in crisis. Consent for a case study is not consent for an advert.

Outside the US

In the UK, the Fundraising Regulator's Code of Fundraising Practice covers online fundraising, and the Charity Commission for England and Wales publishes guidance on charities and social media. Other countries have their own rules.
